We are urging all our members to support NUJP-Iloilo on their invitation to condemn the election related violence that happemed in Mindanao. The text of the invitation states:

"The National Union of Journalists of the Phil (NUJP) - Iloilo invites all journalists and fellow Ilonggos to a nationwide indignation and prayer rally to condemn the Maguindanao massacre and to honor the victims, on Wednesday, Nov. 25 at the grounds of the Jaro Cathedral. Pls bring candles and pls pass."

The prayer rally will be at 4 PM.

I am asking for your active involvement in asking for the immediate and decisive government action on this. Two of our women colleagues were brutally killed in the incident. Unless government is prodded to act immediately on this, we may see more and more people, friends, and colleagues perish in the 2010 elections.

Lawyers: Enforce environmental laws or else…

THE Integrated Bar of the Philippines (IBP)-Iloilo Chapter will badger local government units to enforce dormant environmental laws, particularly solid waste management.

Atty. Marven Daquilanea, IBP-Iloilo president, yesterday gave a demand letter to the Iloilo City government through Community Environment and Natural Resources officer Noel Hechanova.
The letter asked Mayor Jerry Treñas provide within 24 hours a list of city barangays that failed to implement Republic Act 9003 (Ecological Solid Waste Management Act of 2000).

Environmental lawyer Antonio Oposa said the demand letter is one of the legal instruments they will use to force LGUs to enforce environmental laws.

“Nothing personal. The things we are doing now could have been done decades ago. We need a legal revolution to save the environment. The Philippines is most vulnerable to climate change and rising sea level,” Oposa said.

Oposa said they will also file collective petitions, environmental audits, notice to sue and administrative actions against local officials who fail to implement environmental laws.

Henchanova said they are disappointed with the implementation of RA 9003 because some barangay officials are apprehensive to enforce even just the anti-littering ordinance.

“These are realities that we have to face in our work. Barangay officials fear to cross their relatives who violate the law,” Hechanova said.

Lagdameo leads faithful in praying for country's fate

Such words ended the very short message of Msgr. Angel Lagdameo, archbishop of Jaro and president of the influential Catholic Bishops Conference of the Philippines (CBCP), in yesterday's anti-Charter change rally at the Iloilo Provincial Capitol grounds.

An estimated 2,000 people gathered yesterday afternoon at the Provincial Capitol grounds to protest moves to amend the constitution, particularly House Resolution 1109 which paved way for the creation of a constituent assembly.

The protest was organized by the Ilonggos' Movement Against Arroyo's Charter Change (I-March), a multisectoral group headed by lawyer Joshua Alim.

Before converging at the Capitol grounds protesters gathered at two assembly points -- the St. Clement's Church and Plaza Libertad – then march to the rally venue where a program was held.

In his message, Lagdameo urged politicians and public figures contemplating on running in 2010 not to use the campaign against Charter Change as a platform for their candidacy.

"We might lose our focus, which is to oppose constituent assembly," Lagdameo said, as he reminded politicians that the campaign against constituent assembly "is not the occasional for campaigning."

But, Lagdameo stressed, his reminder does not mean that politicians are not welcome in public protests against House Resolution 1109. We welcome their presence, in fact it is a statement of their solidarity with the people, the Archbishop said.

Lagdameo's five-minute long message made quiet an impact on the protesters mainly because two priests unveiled a streamer on which was written: Con-con Yes!Con-ass no!"

"What need I say? Everything that I need to say is already here, in front of you. You can just simply read it," he said, with Msgr. Meliton Oso and Fr. Mark Senina beside him, holding the streamer.

Likewise, Lagdameo assured the protesters that the church is supporting their cause. "We in the church, the clergy, are together with you. We are marching with you. We heed your sentiments, and therefore we are supporting your cause of protest."

Lagdameo then led the people to pray “Ginoo malooy ka (Lord have mercy)” and “Kristo malooy ka (Christ have mercy).”

Also seen joining the protest were former presidents of the Integrated Bar of the Philippines (IBP) – Iloilo Chapter who also issued their position paper calling for the scrapping of HR 1109 or the move to amend the constitution through constituent assembly.

Current IBP president Atty Marven Daquilanea said HR 1109 is unconstitutional and immoral.

Among the prominent personalities who joined the protest were former Agriculture secretary Rene Villa, former city councilor Atty. Benjie Gengos and former Mayor Mansueto Malabor.

Alim said their call for the junking of the Con-Ass does not stop with yesterday's protest action. He said they will remain vigilant against the moves of the administration to tinker with the constitution before 2010.

Lawyers slam House for approving Con-Ass

LAWYERS in Iloilo City slammed the House of Representatives for adopting Resolution 1109, which seeks to convene Congress into a constituent assembly (Con-Ass) to amend the 1987 Constitution.

In a resolution, the Integrated Bar of the Philippines (IBP)-Iloilo Chapter headed by lawyer Marven Daquilanea as president said the approval of HR 1109 in the House without the Senate’s participation is in contravention of the bicameral nature of Congress and the spirit and intent of the Constitution.

Former presidents of the IBP also said the adoption of HR 1109 “inescapably displays the arrogance of power by members of the House of Representatives in their adherence of the tyranny of their numbers, a conduct unbecoming of members of a collegial legislative body in a democratic government.”

The group also said the adoption of the House resolution is a despicable act of disrespect to fellow members of Congress, if not a virtual denial of the existence of a co-equal Chamber or the Senate in Congress.

The lawyers also said in a statement that the act of ¾ members of the House is an act demonstrative of the insensitiveness of the ruling party in the government to the voices of dissent and protests expressed by the people.

A reaction paper dated June 10, 2009 was signed by IBP former presidents Norberto Posecion, Vicente Gengos Jr., Arturo Alinio, Rey Padilla, Angelo Robert Aninao, Amelita K. del Rosario-Benedicto, and Virgilio Teruel.

Posecion, IBP president in 1979-1981, said they are not against the Charter change, provided it is being done after the 2010 presidential elections and that the mode shall be a Constitutional Convention with delegates voted by the people.

The congressmen of Western Visayas who signed HR 1109 are Representatives Florencio Miraflores of Aklan; Jeffrey Ferrer, Alfredo Marañon, Genaro Alvarez Jr., Jose Carlos Lacson, and Ignacio Arroyo, all of Negros Occidental; Raul Gonzalez Jr. of Iloilo City, Ferjenel Biron, Judy Syjuco, Niel Tupas Jr., Arthur Defensor Sr. and Janette Garin, all of the province of Iloilo; JC Rahman Nava of Guimaras, and Fredenil Castro of Capiz.

Those who failed to sign the resolution are Representatives Exequiel Javier of Antique, Monico Puentebella of Bacolod City, and Antonio del Rosario of Roxas City.

It was in law school when I first conceived this idea.

I noticed that despite having two degrees, i.e., Pre-Law and Law Proper, and further considering having passed the Civil Service Professional Exam for those Pre-Law courses which have no Licensure examination, law graduates have no title by which they can be properly addressed.

Before going further, let me get this straight. I know that once I post this message, a lot of comments will surely flood this thread. I am certainly not after titles or designations but let us be practical and realistic. Having two degrees or more, one of which is Law, is definitely something. Everybody knows that. But just because a Law graduate did not make it in the Bar Exams, it seems that his or her two degrees have no value at all.

Let's face it: not all Bar examinees are going to become lawyers. At least during the moment when he or she failed on his or her first, second, or even up to fifth attempts. But what happens if he or she never makes it after the fifth attempt? Will his or her two degrees amount to nothing? As I'm saying this, again, I know, those who read this would like to post their comment right away.

But hear me on this first. I know you want me to spell out what I have in mind. Here it is: I'm proposing a Resolution to the Hon. Supreme Court for the latter to grant title to Law graduates who have passed the Career Service Professional Exam or other equivalent licensure examination. You might want to suggest the title for the Hon. Supreme Court to consider.

I had been looking for my proposed Resolution for sometime now in my files. There I have stated in the preamble the reasons why law graduates should have appropriate title by which they can be addressed. Of course, not the title "Atty." but at least a more dignified one. We don't want them to be ridiculed just because they failed the Bar exams.

As you well knew, non-lawyers are allowed to appear in lower courts. In my practice, I am quite uncomfortable each time the Hon. Judge calls a law graduate simply as "Mister" or "Miss". A distinction between a plain high school graduate and a Law graduate should at least be made.

So, what do you think? Am I just wasting your precious time making unmeritorious proposal or will you be bold enough to consider it? Your suggestions and even your own version of the proposal will certainly be appreciated.
